The Order and CPA Canada before the Supreme Court

Montreal, February 20, 2017 – On March 27, 2017, the Order and CPA Canada will appear before the Supreme Court as part of an appeal of a decision by the Court of Appeal of Quebec, which concluded that the exceptions in professional laws (in this case, the Act respecting the Barreau du Québec) that reserve the practice of some professional activities should be broadly interpreted.
The Order will argue that, contrary to the decision of the Court of Appeal, it is the professional laws that reserve professional activities, and not the exceptions under such legislation, that should be broadly and liberally interpreted to ensure the protection of the public.
The Order will also defend the position that while an exception to reserved activities should be narrowly interpreted, it should also, in some cases, be broadly and liberally interpreted when it authorizes a member of a professional order to engage in such reserved activities.
The Order will therefore maintain that the Court must recognize the special rights granted to CPAs under the Act respecting the Barreau du Québec allowing them to draw up objection and appeal proceedings and represent their clients in disputes with the CRA and Revenu Québec.
