Lawsuit filed by the Order: No suspension of the act pending a decision on the merits

On August 2, a new development took place in the lawsuit filed by the Order to protect professional secrecy of CPAs in light of the authorization to disclose to the Autorité des marchés financiers (AMF) any contravention of an Act enforceable by the AMF. The application for a suspension of the contentious provision regarding CPAs during the proceedings (application to stay) was dismissed by the Honourable Judge Lukasz Granosik of the Superior Court.
The Order is currently reviewing the decision with its attorneys and will update members as the case moves forward.
In the meantime, CPAs are encouraged to read the temporary guidelines made available to help them in their assessment when they detect a contravention of an Act enforceable by the AMF.
